Introduction

This book contains the Staff Regulations and the Staff Rules of the International Seabed Authority (‘the Authority’) which implement Article 167 and Article 168, paragraph 4, of the United Nations Convention on the Law of the Sea (‘the Convention’). Both texts embody the fundamental conditions of service and the basic rights, duties and obligations of the staff of the Authority. They also represent the broad principles of personnel policy for the staffng of the Secretariat. While the Authority is an autonomous international organization which was established by the Convention, theAssembly of theAuthority decided at its thirty-ninth meeting on 29August 1996 that theAssembly would apply mutatis mutandis the Staff Regulations of the United Nations pending the approval of its own Staff Regulations. 1 During 1997, the Secretariat drew up draft Staff Regulations that were based substantially on the Staff Regulations of the UN. These were subsequently revised following signifcant amendments to the Staff Regulations of the United Nations that the General Assembly of the United Nations approved in 1998. The revised draft Staff Regulations of the Authority were submitted to the Finance Committee for consideration at the ffth session in 1999 before being examined by the Council in the course of the sixth session in 2000 (ISBA/6/C/L.2). In accordance withArticle 162, paragraph 2, (o), (ii) of the Convention, at its sixty-ninth meeting on 13 July 2000, the Council decided to adopt and apply provisionally the Staff regulations of theAuthority, pending their approval by theAssembly. The decision of the Council is contained in the document ISBA/6/C/10 to which is annexed the Staff Regulations. 2 Taking into account the recommendation of the Council, the Assembly approved the Staff Regulations by decision dated 10 July 2001 at its seventy-ninth meeting, in accordance with Article 160, paragraph 2, (f), (ii) of the Convention. 3
